Facts:
Plaintiff unit owners brought an action against
defendants, builders and a management company, for breach of contract, breach
of warranty, breach of fiduciary duties, negligence, and fraud. The court granted motions to quash service of
process, ruled that plaintiff unit owners could not maintain a class action,
and sustained certain demurrers of defendants, builders and a management
company, in plaintiffs' action for breach of contract, breach of warranty,
breach of fiduciary duties, negligence, fraud, and antitrust violations. The
court held that there was no common denominator that allowed plaintiffs' class
action.

- Naked allegations of fraud and misrepresentation, negligence, or contractual breaches, express or implied, are not sufficient to give rise to the exercise of personal jurisdiction under the statutory umbrella of transacting business in this state or causing tortious injury by an act or omission in the state.
